ONLINE STORE REGULATIONS

I. TECHNICAL CONDITIONS FOR USING THE STORE

 

The seller provides the following online services to users: a. the ability to enter into contracts in the store; b. the ability to create a user account in the store; c. sending commercial information related to ordered products.

The user has the right to withdraw from sales contracts for goods in accordance with legal regulations and provisions set forth in these regulations. Complaints regarding services provided by the seller through electronic means can be submitted by sending a complaint to the email address: austeria@austeria.pl. The user’s complaint must include the identification of the recipient of the service and a brief description of the complaint. The seller will make every effort to examine the reported complaints as soon as possible, but no later than 14 days from the date the seller received the complaint. The user will be informed via email, phone, or a message sent to the email address provided by the customer about how the complaints will be examined. The seller informs that they are committed to ensuring that the use of the store is as secure as possible for users. However, the seller informs that a particular risk associated with the use of the store, as well as all other websites, is the potential threat of unauthorized access to the store by third parties (so-called hacking), which can cause unforeseen changes in the store’s operation.

 

II. PLACING ORDERS

 

Orders can be placed by users: via the website: 7 days a week, 24 hours a day. Each product has its image. When placing an order, the user: specifies the ordered products, including their quantity; provides their data to the seller; specifies the method of payment and shipping; confirms the order by clicking the “Proceed to Checkout” button. After placing the order, the user will receive an order confirmation email from the seller at the provided email address. Upon receipt of the confirmation, a contract is concluded. Before accepting the order, the seller may contact the user, for example, in case of doubts, the need for clarifications regarding the order, or any product shortages. In justified cases, particularly in case of doubts about the accuracy of the data provided by the user, the seller reserves the right to refuse to execute the order. In the event of unavailability or temporary unavailability of the product, the seller will immediately contact the user at the email address or via phone in order to resolve the situation. The contract is concluded when the user receives information from the seller, at the email address provided by the user, that the order has been accepted for execution. The contract is concluded in the Polish language.

 

III. PAYMENT METHODS

 

All product prices are expressed in Polish zloty and include VAT. The seller reserves the right to change the prices of products on the website. The changes made do not apply to orders placed prior to the price change. The user can pay for the ordered product: upon delivery (cash on delivery); to the seller’s bank account (the account number will be sent to the user via email along with the order confirmation); via the Dotpay system: express transfer or credit card. In the case of payment by bank transfer (via the Dotpay system or traditional transfer), the seller expects payment within 14 days from the order date. After this period, the order is automatically canceledTogether with the product delivery, the user will receive a VAT invoice.

 

IV. ORDER PROCESSING TIME

 

The order will be prepared for shipment within a maximum of 7 working days from the date of the order (due to epidemic restrictions). The seller undertakes to deliver the product to the user as soon as possible, but no later than 30 days. The delivery of the product occurs at the moment of handing over the product to the delivery service. The seller will deliver the ordered product via postal service or courier, depending on the user’s choice indicated by the user. Shipping costs: In the case of an order paid by bank transfer or Dotpay, with a value exceeding 50 PLN, the shipping costs are borne by the seller. In all other cases, the shipping costs are as follows: 11 PLN for a package. In the case of an order paid on delivery, with a value exceeding 50 PLN, the shipping costs are borne by the seller. In all other cases, the shipping costs are as follows: 16.00 PLN for a package.

International shipping: In the case of international shipping, the shipping costs are borne by the user. These costs are individually calculated based on the rates of the Polish Post, according to the weight of the order and the destination country.

 

V. CONSUMER’S RIGHT OF WITHDRAWAL FROM THE CONTRACT

 

The user who is a consumer and has entered into a contract has the right to withdraw from the contract within 14 days without providing any reason. The withdrawal period expires 14 days after the day: (a) on which the consumer acquires physical possession of the product, or in the case of sales contracts, on which a third party other than the carrier and indicated by the consumer acquires physical possession of the product.

To exercise the right of withdrawal, the consumer must inform the seller of their decision to withdraw from the contract by sending a communication to the email address: austeria@austeria.pl. To meet the withdrawal deadline, it is sufficient for the consumer to send the seller a communication regarding the exercise of the right of withdrawal from the contract before the withdrawal period expires. In the event of withdrawal from the contract, the seller will refund to the consumer all payments received from them, including the costs of product delivery (except for additional costs resulting from the consumer’s choice of a delivery method other than the least expensive method offered by the seller), without undue delay and in any case not later than 14 days from the day on which the seller was informed by the consumer of their decision to withdraw from the contract. The seller may withhold the refund until the product is received or until the consumer provides proof of returning the product, whichever occurs first. In the event of withdrawal from the contract, the consumer must return or deliver the product to the seller at the address: Wydawnictwo Austeria, Szeroka 6, 31-053 Krakow, Poland, without undue delay and in any case not later than 14 days from the day the consumer informed the seller of the withdrawal from the contract. The deadline is met if the consumer returns the product within 14 days. The consumer is only liable for any diminished value of the product resulting from the handling of the product other than what is necessary to establish its nature, characteristics, and functioning.

 

VI. PERSONAL DATA

 

The seller is the data controller. The data will be processed for the purpose of order processing. The user has the right to access and correct their data. The provision of data is optional, but the failure to provide data prevents the submission of the order and the conclusion of the contract.

Orders cannot be placed anonymously.

 

VII. WARRANTY AND COMPLAINTS

 

The consumer has the right to lodge a complaint regarding physical or legal defects of the delivered product. The complaint should be sent to the seller at the address: Wydawnictwo Austeria, Szeroka 6, 31-053 Krakow, Poland, together with the claimed product and a written justification on the back of the invoice (e.g., missing pages, unprinted pages, damage during transportation, or personal delivery). Complaints will be examined within 14 days from the date of receipt of the shipment with the claimed product by the seller. The seller will inform the user of the complaint result via email or phone. If the data or information provided in the complaint require supplementation, before examining the complaint, the seller will request the user who submitted the complaint to supplement them to the extent indicated. In such a case, the 14-day period will be calculated from the date of transmission of the information necessary to examine the complaint. In the case where the user is not a consumer, the seller’s liability for warranty is excluded.

 

VIII. FINAL PROVISIONS

 

These regulations come into effect on January 1, 2018. To place an order, it is necessary to read the regulations and select the appropriate box in the order form to confirm that you have read and fully accepted all the provisions of the regulations. The seller reserves the right to makechanges to the regulations to the extent permitted by law. Polish law is competent to resolve any disputes arising from these regulations. Such disputes will be resolved by the competent court based on the location.
